Yeah, this is pretty obvious. An employer should have literally zero control over what I'm doing when I'm not being paid. If an adult wants to smoke pot on the weekends that is their business and their business alone. I don't care what law is on the books at whatever geographical coordinates. If your job is being completed, their control should end precisely there.

You have to talk about weed because it is tested for. Maybe your company makes an exception but most do not. I have not heard of one myself that does. It stays in your system for a month. Drug testing won't catch anyone doing opiates anyway if they stay clean for 48 hours. Obviously, they would prior to a test I assume.

well if we are talking about weed then I can't argue that...and I know other companies (small businesses) that don't care about testing positive for weed either.

and I need to test for other drugs. I can't take a chance on hiring a person (not knowing they might have a drug issue) and have them go into my clients homes and potentially take their prescription pills....in fact I've had it happen and I can tell you it is a nightmare from a legal/state standpoint.

2 weeks ago we sent a new hire for a pee test. She called from said pee test location and said that the place want to now watch her take the test because the first one was not the right temperature. She said she didn't feel comfortable and she was leaving. So we told her if she wants the job she needs to take the test again and pass but this time she would have to pay for it since she chose to leave that day. She said she would go again in a couple days....never heard from her again.
